Terms and Conditions of Sale – Enerco Doors & Loading Bay Solutions Limited

1. Damaged/Faulty goods. All goods should be examined on receipt for damage or incorrect quality. In event of fault the carrier should be notified immediately. Replacement goods due to loss or damage on site will be fully chargeable.

2. Product Guarantee. Unless otherwise stated, the products in this quotation are guaranteed against defects and faulty workmanship excluding wearable items such as belts, ropes, chains and any other components damaged as a result of their failure for 12 months from the date of despatch, provided that: -

1. The products have been used for their intended purpose.
2. They have not been subjected to misuse.
3. They have not been wilfully or accidentally damaged.
4. They have not been tampered with or repaired by anyone other than ENERCO or its authorised Service Engineers.
5. The equipment has been serviced in accordance with the manufactures instructions.

3. Preparatory Work. All necessary site clearance, building, installation or power supply work should be completed before we commence work. We reserve the right to charge for return visits by our engineers caused by such delays.

4. Numbers of visits. Unless otherwise stated, our quotation covers one complete visit by our engineers. Extra visits caused by others will be charged as Day work.

5. Items excluded from our quotation: (Unless otherwise stated in our quotation,)

1. Completion of all preparatory work as specified.
2. Off-loading of our products and safe, dry storage under cover.
3. Handling or carnage if required by site conditions.
4. Lowering of Dock Levellers into prepared pits.
5. A working power supply with isolator, earth and neutral (per product, when electrically operated) Within 1000mm of the opening, 1500mm from ground level.
6. Extra trunking or conduits (normal is armoured cable).
7. Extra remote control equipment (e.g. second induction loop detector necessitated by interference from site conditions, such as metal objects or reinforcement in the floor).
8. For Sectional Slideover Doors, a steel frame onto which our tracks and springs can be mounted.
9. Gallows equipment for overhead pulled switches.
10. Weekend working or unusual hours.
11. Rubbish skips for clearing of rubbish i.e. old doors etc.

6. Equipment and Assistance required for our fitters.

• Power supplies for tools within 20 meters of the working area single phase or 110V.
• Adequate light. Vehicular access.
• At least one fork truck to lift 1000kg to 1000mm above door height.
• Experienced driver for fork truck. (As above)
• For Sectional Slideover Doors – adequate protection for door panels after installation to protect from damage by other trades.
• Standard access equipment includes for a working platform (standing height) of 5000mm. Should installation require a working platform in excess of 5000mm ENERCO reserve the right to charge extra for this facility unless agreed in writing.

7. Notice of Commencement. If not agreed at the time of ordering, we require a minimum of 14 days notice for the commencement of work.

8. Stage Payments. If Materials are delivered or held by ENERCO in advance of the agreed start of installation work, an interim invoice will be issued to cover the value of the materials. Prompt payment of interim invoices will be expected, in accordance with our standard terms.

9. V.A.T. This will be charged as extra at the rate in force at the Tax Point.

10. Main Contractors Discount. Unless otherwise specified, all prices are strictly net, and exclude Main Contractors Discount.

11. Terms of payment. Assuming credit facilities are granted, our terms are strictly net 14 days for new products and net 30 days for service work. Should account facilities not be available, we will require 50% with the order and then the balance on completion. Cheques should be posted with the order for the deposit, and settlement given to our engineers on completion. Cheques should be made payable to: Enerco Doors & Loading Bay Solutions Limited.

• Our Invoices become due for payment within 30 days from the date of issue.
• If after 30 days this invoice is not paid in full we reserve the right to charge interest on the outstanding balance at 5% above Bank Base Lending Rate from the date of the invoice until such time that the account is paid in full.
• Should payment not be made for work done to date or equipment supplied, as per our terms and conditions we reserve the right to suspend further work or the supply of further equipment within the contract until such time as payment shall be made. Any such suspension of work or deliveries of material shall not give the customer right to cancel the agreement nor claim for compensation.

12.. Quotation Validity. Except for currency fluctuations (see Clause 13) this quotation is open for acceptance within a period of 90 days, after which it may be subject to change. Any change will be notified in writing.

13. Currency Exchange Rate. The prices in this quotation are based on the Currency Exchange Rates published within 10 days prior to the date of the quotation. Should the Exchange Rates vary to the detriment of the Pound Sterling by more than 2.5% at any time up to the full payment by the Customer of our invoice, we reserve the right to increase the prices quoted, by way of surcharge.

14. Retention of Title. All products supplied will remain the property of Enerco Doors & Loading Bays Solutions Limited until paid for in full.

15. Specifications and Drawings. These remain the property of ENERCO and must not be shown or made accessible to third parties without our written consent. Copyright expressly reserved.

16. Please note that ENERCO will not accept instructions for its labour to work outside the confines of the safe working practise guidelines as set out or otherwise implied in law.

17. Cancellation of Order. ENERCO reserve the right to charge a percentage of the overall order value in the event that any order is cancelled following receipt of the Customers order and instruction to proceed. This percentage will reflect the administration and any materials or labour costs incurred by ENERCO. The percentage rates are: - Cancellation within 3 days – 50%. Cancellation within 7 days – 75%. Cancellation within 24 hours of the date agreed for installation – 90%. Cancellation of orders where engineers are already despatched to repair or commence an installation will be charged travel to and from the site and a mileage charge.

18. Amendment to Order. We reserve the right to charge for any amendments made to an order following the order date.
